A spammer that had been sent to prison was found guilty by Virginia's Supreme Court in his attempt to appeal his case.  He was sentenced to nine years.

The sentence is the result of Jeremy Jaynes of Raleigh, North Carolina sending what is believed to be millions of messages in 2003.  While his original sentenced was upheld by the Virginia Supreme Court, it was by a narrow vote of 4-3.

Even though Jaynes is believed to have sent 10 million emails daily over the course of two months in 2003, the prosecution presented 53,000 in their case against him.  Since the servers that were utilized to send the spam were located in Loudoun County, Virginia they were the ones responsible for charging him instead of his native North Carolina.

The defense lawyers tried to say that Jaynes free speech rights were being violated, so the upholding of his previous case shows that our First Amendment rights do not include the right to spam.
